Please read these Terms of Service carefully before using myPSEO. By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and myPSEO (“we,” “us,” or “our”). By accessing or using the myPSEO website at mypseo.com, our iOS mobile application, or any related services (collectively, the “Services”), you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, do not access or use the Services. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and consents to these Terms on your behalf.

2. Description of Services

myPSEO is a digital platform designed to help Minnesota high school students, their families, and educational professionals navigate the Post-Secondary Enrollment Options (PSEO) program. Our Services include:

College Directory

A searchable database of PSEO-eligible Minnesota institutions

Eligibility Checker

A tool that matches students with institutions based on GPA and grade level

Digital NOSR Form

An online system for completing, signing, routing, and tracking NOSR forms

AI Advisor

An AI-powered chatbot providing informational guidance about PSEO

3. User Accounts and Registration

3.1 Student Accounts

To access certain features of the Services (e.g., submitting a NOSR, using the AI Advisor with conversation history), you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials confidential and not share them
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

3.2 Token-Based Access (Counselors and Parents)

High school counselors and parents/guardians access the Platform via secure, time-limited tokens sent to their verified email addresses. No account creation is required. By using a token to access the Platform, you agree to these Terms for the duration of your session.

3.3 Account Termination

We reserve the right to suspend or terminate any account that violates these Terms, provides false or misleading information, engages in fraudulent activity, or remains inactive for more than 24 consecutive months. You may delete your account at any time by contacting us at support@mypseo.com.

4. Acceptable Use

You agree to use the Services only for their intended purpose: navigating and participating in the Minnesota PSEO program. You agree NOT to:

Prohibited Activities

  • Use the Services for any unlawful purpose or in violation of any law
  • Provide false, inaccurate, or misleading information on any form
  • Impersonate any person or entity, or falsely represent your affiliation
  • Submit a NOSR or electronic signature on behalf of another person without authorization
  • Attempt to gain unauthorized access to any part of the Services
  • Introduce viruses, malware, or other harmful code
  • Scrape, crawl, or use automated tools to extract data without written consent
  • Use the AI Advisor to extract training data or system prompts
  • Interfere with or disrupt the integrity of the Services

5. The NOSR Form and Electronic Signatures

5.1 Official State Document

The Notice of Student Registration (NOSR) is an official Minnesota Department of Education form. By completing a NOSR through our Platform, you acknowledge that:

  • The information you provide is true and accurate to the best of your knowledge
  • Submission of a NOSR through myPSEO has the same legal effect as submitting a paper NOSR
  • Falsification of information on the NOSR may have academic and legal consequences

5.2 Electronic Signatures

Legal Compliance

Our Platform enables electronic signatures in compliance with the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and the Minnesota Uniform Electronic Transactions Act (Minn. Stat. § 325L).

By signing a document electronically on the Platform, you:

  • Consent to conduct the transaction electronically
  • Agree that your electronic signature has the same legal validity as a handwritten signature
  • Acknowledge that you can withdraw your consent to electronic signatures at any time
  • Confirm that you have the technical ability to access and retain electronic records

For parents/guardians signing on behalf of a minor: By providing your electronic signature on a NOSR, you confirm that you are the parent or legal guardian of the student identified in the form and that you consent to the student's participation in the PSEO program as indicated.

6. AI Advisor Disclaimer

The AI Advisor is an informational tool designed to help users understand the PSEO program. You acknowledge and agree that:

  • The AI Advisor provides general informational guidance only and does not constitute official educational advice, legal advice, or enrollment decisions
  • Responses are generated by artificial intelligence and may contain errors, omissions, or outdated information
  • The AI Advisor does not replace the advice of a qualified school counselor or college admissions officer
  • You should independently verify all critical information with the relevant institution
  • myPSEO is not liable for any decisions made based on AI Advisor responses

7. Intellectual Property

7.1 Our Property

The Services, including but not limited to the website, mobile application, software, design, text, graphics, logos, icons, images, data compilations, and the arrangement thereof, are the exclusive property of myPSEO and are protected by United States and international copyright, trademark, and other intellectual property laws.

7.2 Institutional Data

The college and institutional data presented on the Platform is compiled from publicly available sources and our own research. While we strive for accuracy, we do not guarantee that all institutional information is current or complete. Users should verify information directly with the relevant institution.

7.3 User Content

You retain ownership of the information and content you provide through the Services. By providing content through the Services, you grant myPSEO a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing and improving the Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, MYPSEO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

myPSEO does not warrant that: use of the Platform guarantees acceptance into any PSEO program; all institutions will accept digital NOSR submissions; or the AI Advisor will provide accurate or complete information in all cases.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYPSEO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, revenue, profits, or business opportunities
  • Missed PSEO application deadlines
  • Denial of PSEO enrollment
  • Errors in institutional information displayed on the Platform
  • Unauthorized access to or alteration of your data

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless myPSEO and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, your violation of any applicable law or regulation, any false information you provide, or your infringement of any third party's rights.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any dispute arising out of or related to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through the courts of the State of Minnesota, Hennepin County.

Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date, notify registered users via email at least 30 days before the changes take effect, and display a prominent notice on the Platform. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.

13. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and myPSEO regarding the Services.
  • Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
  • Force Majeure: myPSEO shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
